1. INTRODUCTION

These Terms and Conditions (“Terms”) govern the purchase of vehicles from Master Garage Nottingham (“We,” “Us,” or “the Dealer”). By purchasing a vehicle from us, you (“Customer” or “You”) agree to be bound by these Terms.

The sale of vehicles is governed by the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008. Nothing in these Terms excludes, restricts, or limits your statutory consumer rights.

2. VEHICLE CONDITION AND INSPECTION

2.1 Vehicle Standards

All vehicles sold by Master Garage Nottingham are:

  • Of satisfactory quality
  • Fit for their purpose (as a vehicle for transport)
  • As described in our advertisements and communications

2.2 Pre-Purchase Inspection

Every vehicle has undergone:

  • Full mechanical inspection
  • HPI check (History and Ownership verification)
  • Safety and emissions testing
  • Roadworthiness assessment

2.3 Vehicle Condition

Vehicles are sold on an “as seen” basis. Customers are entitled to view, inspect, and test drive the vehicle before purchase. We recommend independent inspection if you have concerns.

2.4 Fair Wear and Tear

We are not responsible for natural wear and tear that occurs after the vehicle leaves our premises (e.g., minor scratches, tyre degradation, cosmetic damage from regular use).

3. PURCHASE AGREEMENT AND PAYMENT

3.1 Offer and Acceptance

Your purchase of a vehicle constitutes an offer, which We accept upon payment in full. No vehicle is reserved until payment is received in cleared funds.

3.2 Payment Methods

We accept:

  • Bank transfer (cleared funds only)
  • Debit/credit card (subject to Merchant Services terms)
  • Finance arrangements (see Section 4)
  • Cash (up to £10,000, subject to AML verification)

3.3 Payment in Full

The vehicle must not be collected or used until the full purchase price has been paid in cleared funds. Failure to pay forfeits your right to purchase.

4. VEHICLE FINANCE

4.1 Finance Agreements

Finance is arranged through third-party lenders. We act as an intermediary only. Finance terms, conditions, and interest rates are governed by the finance provider’s agreement, not these Terms.

4.2 FCA Compliance

All finance agreements comply with the Financial Conduct Authority (FCA) regulations and Consumer Credit Act 2015. You will receive a separate finance agreement and information sheet before committing to finance.

5. PART EXCHANGE

5.1 Part Exchange Valuation

If you trade in a vehicle with us:

  • The valuation is based on the condition at the time of assessment
  • The vehicle must be in the same condition when delivered (fair wear and tear excepted)
  • Significant deterioration between assessment and delivery may result in adjusted valuation

6. CONSUMER RIGHTS ACT 2015 – YOUR STATUTORY RIGHTS

6.1 Right to Reject

If a vehicle fails to meet the standards in Section 2 within 30 days of delivery, you may reject it and receive a refund (subject to the condition below).

6.2 Right to Repair or Replacement

If a fault is identified after 30 days but within 6 months, we will:

  1. Attempt repair at no cost to you
  2. If repair fails, offer a replacement vehicle or refund
  3. Not attempt multiple unsuccessful repairs

7. COOLING-OFF PERIOD (RIGHT TO CANCEL)

7.1 Cancellation Right

You have 14 calendar days from the date of purchase to cancel this agreement and receive a full refund (Distance Selling Directive). This applies only to purchases made online or at distance.

8. VEHICLE DELIVERY AND COLLECTION

The vehicle becomes your responsibility from the date of delivery. At this point:

  • You are responsible for insurance
  • You assume all risk of loss or damage
  • You are responsible for any defects unless reported within 30 days

9. WARRANTY AND AFTER-SALES SUPPORT

Warranties are available at point of sale and are optional. Warranty terms, conditions, coverage, and exclusions are detailed in the separate warranty document provided at purchase.

10. LIABILITY AND LIMITATIONS

Our liability is limited to the purchase price of the vehicle. We are not liable for loss of profit or use, indirect or consequential losses, or damage or injury caused by the vehicle.

11. DISPUTES AND COMPLAINTS

11.1 Complaint Procedure

If you have a complaint:

  1. Contact us in writing at contact us with full details
  2. We will acknowledge receipt within 2 business days
  3. We will investigate and provide a response within 14 days

12. GENERAL TERMS

  • Vehicle Insurance: You must obtain comprehensive motor insurance before taking delivery.
  • Data Protection: Your personal data is processed in accordance with our Privacy Policy.

13. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales for any disputes.
